State and Federal Wetland Permitting
Wetlands are ecologically sensitive areas that provide essential ecosystem services, and any activities that may impact them are regulated at both the state and federal levels in the United States. The U.S. Army Corps of Engineers (USACE) is responsible for regulating activities that may impact wetlands and other waters of the United States under the Clean Water Act (CWA) and the Rivers and Harbors Act of 1899 (RHA). State environmental agencies typically regulate wetland permitting at the state level. If an A/E/C project involves activities that may impact wetlands, it is important to obtain the necessary permits from both state and federal regulatory agencies to ensure compliance and avoid potential legal and financial consequences.
